Terms of Service
Plain language summary: By using X-ID you agree to use it responsibly, you own your identity data, we own the platform software. The platform is in beta and provided as-is. Don’t use it for illegal purposes. Disputes are governed by the law of England and Wales.
1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the X-ID website at x-id.xyz and the X-ID identity platform at app.x-id.xyz (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms apply to all users, including individual users, organisations accessing the Service via API, and developers building integrations.
2. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Your Account and Identity
3.1 Account Security
You are responsible for maintaining the security of your account credentials, including your cryptographic private keys. X-ID does not have access to your private keys. If you lose access to your private keys, X-ID cannot recover them for you. Keep secure backups of your seed phrase and key material.
3.2 Accurate Information
You agree to provide accurate information when creating your account and to keep it current. Fraudulent account creation, identity impersonation, or submitting false information to obtain verifiable credentials are grounds for immediate termination.
3.3 Decentralised Identifiers
DIDs you create are associated with your wallet address on the Flare Network blockchain. You acknowledge that DID documents and associated smart contract interactions are publicly visible on-chain and cannot be deleted due to the immutable nature of blockchain ledgers. You may deactivate a DID, which updates its status, but historical records remain on-chain.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Create fraudulent verifiable credentials or misrepresent credential issuance
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Attempt to gain unauthorised access to the Service, its servers, or any related systems
- Conduct automated scraping, crawling, or data extraction beyond normal API use within your rate limits
- Use the Service in connection with money laundering, terrorist financing, or other financial crimes
- Circumvent identity verification mechanisms for unlawful purposes
- Harass, abuse, or harm other users
5. Verifiable Credentials
5.1 Credential Integrity
X-ID facilitates the issuance and verification of W3C-standard Verifiable Credentials. You acknowledge that the validity of a credential depends on the integrity of the issuing organisation. X-ID does not guarantee the accuracy of claims made by third-party credential issuers.
5.2 Organisation Issuers
If you register as a credential-issuing organisation, you are solely responsible for the accuracy of credentials you issue, compliance with applicable identity verification regulations in your jurisdiction, and any liability arising from incorrect or fraudulent credentials issued under your organisation account.
5.3 Selective Disclosure
When you use zero-knowledge proofs or selective disclosure features, you control what information is revealed during verification. X-ID provides the technical tools; you are responsible for reviewing each disclosure before authorising it.
6. Beta Service Disclaimer
The Service is currently in beta. Features may be incomplete, contain bugs, or change without notice. Do not rely solely on X-ID for any high-stakes identity decision without independent verification. We recommend maintaining backup copies of important credential data.
7. Intellectual Property
7.1 Our IP
The X-ID platform software, website design, brand assets, and documentation are owned by X-ID and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute our platform software without our express written permission.
7.2 Your Data
You retain all rights to your identity data, including your DID documents and the credentials stored in your wallet. By using the Service, you grant X-ID a limited, non-exclusive licence to process your data solely as necessary to provide the Service as described in our Privacy Policy.
7.3 Feedback
If you provide feedback, suggestions, or feature requests, you grant X-ID a royalty-free, perpetual licence to use that feedback to improve the Service, without any obligation to compensate you.
8. Third-Party Services
The Service integrates with third-party services including the Flare Network blockchain, Cloudflare, and identity credential issuers. Your use of those services is governed by their respective terms. X-ID is not responsible for the availability, accuracy, or conduct of third-party services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, X-ID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO X-ID IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) £100.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. X-ID DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Indemnification
You agree to indemnify and hold harmless X-ID, its officers, directors, employees, and agents from any claim, demand, or damage, including reasonable legal fees, arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms, fraudulent activity, or conduct that we reasonably believe harms other users or the platform. You may terminate your account at any time by contacting [email protected]. Sections 7, 9, 10, 11, and 13 survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved after 30 days, disputes shall be referred to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your jurisdiction require otherwise.
14. General
- Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and X-ID regarding the Service.
- Waiver: Our failure to enforce any right under these Terms shall not constitute a waiver of that right.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Updates: We may modify these Terms at any time. We will provide reasonable notice of material changes. Continued use after changes constitutes acceptance.
